とされており、米国人が高麗航空機に搭乗することが禁止されたとも取れるような規定がある。これが、現実的に、平壌－北京間に就航している高麗航空機に適用されるのかは分からないが、もしそういうことになると、米国人は平壌に行く際、中国国際航空を利用しなければならないということになる。

2日、「朝鮮中央TV」でも流れていたが、「朝鮮アジア太平洋平和委員会」が声明を出した。全文は長いので、今回の制裁と関連する部分を抽出し訳出しておく。

特に、今回の「制裁決議」は、今まで実行してきた、いわゆる「制裁の抜け穴」を埋めるという美名の下、我々、人民生活の領域にまで、その魔手を深く伸ばしている。これは、我々が、生き、生存すること自体を許容しようとしない昼強盗的本性をそのままあらわしたものである。
더구나 이번 《제재결의》는 지금까지 실행해온 그 무슨 《제재의 빈 구멍》을 메꾼다는 미명하에 우리 인민생활의 령역에까지 그 마수를 깊숙이 뻗치고있다.이는 우리가 살아 생존하는것 자체를 허용치 않으려는 날강도적본성을 그대로 드러낸것으로 된다.

「彼ら（訳注：米国）の安全と制裁に加担する国々（訳注：中国をはじめとした諸国）の経済的利益を大きく害する」がポイントで、米国はそもそも北朝鮮の核攻撃の標的になっているとして、「生産に加担する国々」で最も「経済的利益を大きく害」される国は中国である。別記事にも書いたとおり、「鉄鋼」という抜け道を作ってくれた中国に、こんなことを言っても良いのだろうか。そして、次のように締めくくる。

1日、「中国外国部定例記者会見」で、安保理決議2321に関する質疑があった。
そのなかで、外交部報道官は、中国が安保理決議に賛成し、中国も北朝鮮の核・ミサイル開発に反対すると述べた上で、北朝鮮の核・ミサイル問題は、朝鮮半島と東北アジアの平和と安定を阻害せぬよう、9.19合意に基づき六者会談を通じて外交的に解決されなければならないとし、以下。
決議は、安保理決議を反映した新たな施策を講ずるものだけではなく、それは朝鮮人民に人道的に悪い結果をもたらすものでもなく、否定的な影響を通常の経済活動と貿易に与えるものでもない。我々は、安保理決議2321は、バランスを維持しながら完全に履行していく。
The resolution not only rolls out new measures which reflect the resolve of the Security Council, but also states that it is not intended to have adverse humanitarian consequences for the civilian population of the DPRK, nor negative impact on its normal economic activities and trade. We maintain that Resolution 2321 must be fully implemented in a balanced way.
と、述べている。確かに、安保理決議2321の冒頭には、「人道」に関する言及があり、それと石炭輸出制限との間に微妙な関係があると思っていた。
さらに、来年の北朝鮮の石炭輸出制限を750万トンに制限することに対する中国としての確認を求められると、
安保理の常任理事国として、中国は安保理決議（複数）を国連憲章に書かれているとおり、責任を持って、国政的責務を履行してきた。我々は、誠意を持って、安保理決議2321を遵守する。
A: As a permanent member of the UN Security Council, China has been implementing Security Council resolutions in a responsible manner, and performing its due international obligations as prescribed in the UN Charter. We will faithfully observe Resolution 2321 of the Security Council.
と述べている。
石炭輸出制限に関しては、安保理決議2321をどう読んでもひっくり返せないと思うが、やはり、昨日の記事に書いたように、鉄鋼貿易を拡大し、石炭輸出減少分をカバーすることを考えているのかもしれない。
中国内の北朝鮮外交使節人数削減についても、「安保理決議2321を遵守する」と応じている。

以下、その内容。
安全保障理事会が、9日に開催した我々の核弾頭爆発実験を問題視する「制裁決議を」でっち上げた。
유엔안전보장리사회가 지난 9월에 진행된 우리의 핵탄두폭발시험을 걸고드는 《제재결의》를 조해냈다.
これは、米国の手のひらの上で踊らされている国連安全保障理事会が自己の権能を越え、我が共和国の自衛権を再び否定した越権行為、主権侵害行為であり、我々はこれを強力に糾弾しながら全面排撃する。
이것은 미국의 손탁에 놀아나는 유엔안전보장리사회가 자기의 권능을 벗어나 우리 공화국의 자위권을 부정한 또 한차례의 월권행위,주권침해행위로서 우리는 이를 강력히 규탄하며 전면배격한다.
既に闡明になっているように、9月に我々が成功裏に行った核弾頭爆発実験は、我が国家の自衛的権利行使を悪辣に問題視する米国をはじめとする敵対勢力の核威嚇と制裁騒動に対する実際的対応措置の一環として、敵共が我々に手を出せば、我々も対抗できる準備が出来ているという、我が軍隊と人民の超強硬意志の誇示である。

国連安全保障理事会は、核実験を含む国防力強化措置のような主権国家の自衛権行使を禁止するいかなる権限もなく、国連憲章と、いかなる国際法典でも、核実験が国際平和と安全に脅威となると規制しされていない。
유엔안전보장리사회는 핵시험을 포함한 국방력강화조치들과 같은 주권국가의 자위권행사를 금지시킬 그 어떤 권한도 없으며 유엔헌장과 그 어느 국제법전에도 핵시험이 국제평화와 안전에 위협으로 된다고 규제한것이 없다.
これまで、全ての常任理事国を含む多くの国が、核実験とロケット発射を数千回行ったが、国連安全保障理事会が、それを禁止したことは一度もない。
지금까지 모든 상임리사국들을 포함한 많은 나라들이 핵시험과 로케트발사를 수천번 진행했으나 유엔안전보장리사회가 그것을 금지한적은 단 한번도 없다.
非同盟国をはじめとした全般的国連加盟国が、国際法上に君臨し、列強の政治的道具として盗用されている国連安全保障理事会を直ちに改革することを強く要求している理由がまさにそこにある。
쁠럭불가담나라들을 비롯한 전반적유엔성원국들이 국제법우에 군림하여 렬강들의 정치적도구로 도용되고있는 유엔안전보장리사회를 시급히 개혁할것을 절절히 요구하고있는 리유가 바로 여기에 있다.
法治ではなく、力と強権で左右される現国際関係で、国の自主権を守ろうとすれば、力がなければならず、敵対勢力の核威嚇には核で対応するようになっている。
법치가 아니라 힘과 강권으로 좌우지되는 현 국제관계에서 나라의 자주권을 지키자면 힘이 있어야 하고 적대세력의 핵위협에는 핵으로 대응하게 되여있다.
我々が、核武装を国家路線として打ち立て、万難を克服しながら強力な抑止力を持つことが、千万回、賢明で正当な選択であったということが、現実として証明されている。
우리가 핵무장을 국가로선으로 내세우고 만난을 극복하면서 강력한 억제력을 갖춘것이 천만번 현명하고 정당한 선택이였다는것이 현실로 증명되고있다.
オバマとその手下ごときが卑劣な制裁圧迫で我が国の核武装路線を放棄させたり、核強国の地位を捨てさせることができると考えているのであれば、それ以上の誤算はない。
오바마와 그 졸개따위들이 비렬한 제재압박으로 우리 국가의 핵무장로선을 포기하게 하거나 핵강국의 지위를 허물수 있다고 생각한다면 그보다 더한 오산은 없을것이다.
我々は、奴らといかなる取引もしないし、我々が選んだ正義の道をさらに力強く進んでいく。

制裁は、必ずや緊張激化をもたらすことになり、朝鮮半島と地域の情勢が統制不能の状態に陥る場合、その責任は「制裁決議」でっち上げの首謀者である米国が全的に取ることになるであろう。

これまでの北朝鮮の主張と変わらないが、反応が早かった。
11月30日、国連安保理で安保理決議2321が採択された。北朝鮮からの石炭輸入に量あるいは金額で上限を設定している。UNSCのHPには項目があるものの、全文は未掲載なので、それが掲載された後、詳細を書くことにする。
中国が最大かつほぼ唯一の北朝鮮からの石炭輸入国なので、輸入量と額の確定は比較的容易であろうが、中国が「真面目にやれば」が最大の条件となる。迂回輸出、さらには一時的な保管など、あれこれとやり方はあり得る。
この辺りについて、2321にどのように書かれているかが見物。

Strengthens and expands sectoral sanctions on exports the DPRK can use to raise hard currency that can be used to fund its nuclear and ballistic missile programs. The resolution slashes the DPRK’s exports by:
北朝鮮最大の輸出品目である石炭輸出に上限を設定し、対2015年比で年間約7億ドル（60%以上）削減する。
Imposing a binding cap cutting the DPRK’s largest export, coal, by approximately $700 million per year from 2015 (more than 60%);
上限以内の輸出に関しても輸出条件を厳しくし、北朝鮮の核・ミサイル計画やその他の禁止された活動や計画に、石炭輸出と関連する人物や企業が関与していないことを証明させる。
Tightening the conditions on coal exports under that cap, including by establishing that coal exports may not involve any individuals or entities associated with the DPRK’s nuclear, ballistic missile, or other prohibited programs and activities;
北朝鮮が各国と契約を結ぶことで数千、数百万ドルを獲得してきた銅像輸出を禁止する。
Banning the DPRK’s export of monuments, which the DPRK has used to generate tens of millions of dollars through contracts around the world; and

北朝鮮に持ち込まれたり持ち出される個人の手荷物や預け荷物を検査することを求める。
Requiring that personal luggage and checked baggage going to and coming from the DPRK must be inspected;
北朝鮮国籍の航空機が自国領内に着陸あるいは離陸する場合、検査義務があることを再確認する。また、北朝鮮国籍の航空機に対し、関連する飛行に必要分以上の燃料提供をしないよう注意することを求める。
Reminding states of their obligation to inspect all DPRK-flagged aircraft when they land in or take off from their territory, and calling on states to exercise vigilance to ensure that no more fuel is provided to DPRK-flagged aircraft than is necessary for the relevant flight;

実際に読むまでは、どうせ抜け穴だらけだろうと思ったが、今回の安保理決議2321は、相当強化されていると言える。いずれにせよ、中国がこの決議に含まれた内容をどれほど誠実に実行するのかにかかっている。

北朝鮮国内における石炭需給が逼迫した状況にあるのであれば、対中輸出に回していた石炭を国内消費用に使うことは出来る。一方、石炭輸出制限で減少した外貨は、鉄鋼輸出で（完全ではなくてもある程度）補うことは出来よう。そもそも、北朝鮮の対中輸出品目の割合は、その時々の状況に応じて変化している。ここに「民生目的」を残させたのは中国であろう。
