「国連安保理決議２２７０」：３月２日に全会一致で議決、全文入手 （２０１６年３月２日 「UNSC」）
２日、国連安保理において全会一致で北朝鮮に対する「安保理決議２２７０」が採択された。全文はまだ見ることができないが、UNSCのHPがその概要を伝えている。その内容は以下のとおり。

北朝鮮による石炭、鉄鋼、鉄鉱石、チタン鉱石、バナジウム鉱石、レアアース金属の輸出禁止、北朝鮮に対するロケット燃料を含む全ての種類の航空燃料の提供禁止。
As a result of such incidents, the new measure expands sanctions against the DPRK by imposing a ban on all exports including coal, iron, iron ore, gold, titanium ore, vanadium ore and rare earth metals, and banning the supply of all types of aviation fuel, including rocket fuel.

当初、石炭輸出については「制限」と言われていたが、この報道では「禁止」となっている。石炭は、北朝鮮の主要な輸出品の一つであるだけに、この措置は北朝鮮の外貨獲得に大きな影響を与えることになる。また、「鉄鋼」と「鉄鉱石」を明確に分けているが、これは北朝鮮のくず鉄輸出も禁止品目に指定するためであろう。また、航空燃料については種別を「全て」としている。だとすると高麗航空機が使う燃料の供給もストップすることになる。そうなると、高麗航空機の運航は中断することになり、北朝鮮へのフライトは中国国際航空機のみとなる。また「元帥様」専用機の「オオタカ１号」も飛べなくなる。もちろん、北朝鮮に航空燃料を精製できる施設があれば別ではある。

新決議では、加盟国に、以前のように貿易禁止品目が含まれていると疑われるものだけではなく、北朝鮮との輸出入貨物の全ての検査を要求している。また、北朝鮮に対する船舶や航空機の貸与、また乗務員を提供、船籍登録することを禁止し、既に登録されている北朝鮮が所有あるいは監理する船舶の登録を抹消することを求めている。加えて、加盟国は、禁止品目を積載していると疑われる船舶の入港を禁止と航空機の飛行禁止を決定した。
The new resolution also requires States to inspect all cargo to and from the DPRK, not just those suspected of containing prohibited items, as was previously the case. It also bans leasing or chartering of vessels or airplanes and providing crew services to the country, and registering vessels, while calling on States to de-register any DPRK owned or controlled vessels. Additionally, it decides that States shall ban any flights and deny entry into their ports of any vessel suspected of carrying prohibited items.

この部分は、是非、全文で確認したいところであるが、全量検査義務を空港と港湾においてのみ義務づけているのか、陸路にも義務づけているのかという点である（上の報道からは陸路も含まれているように読み取れるが）。陸路での全量検査が義務づけられれば、その手続きに要する時間だけ考えても、中朝貿易は相当滞ることになる。もちろん、中国側がきちんと対応すればであるが。一方、陸路が曖昧になっていれば、陸路に多くを依存する中朝貿易はそのまま続けられるであろう。また、北朝鮮が制裁を回避するために外国船籍を得られないようにし、さらに既に登録されてる船籍も抹消するように求めている。

金融制裁に関しては、北朝鮮政府あるいは朝鮮労働党が所有あるいは監理する資産と経済源泉が、核・ミサイル開発計画あるいはその他の禁止された活動に結びついていることが発覚した場合、資産凍結を課す範囲を拡大している。

北朝鮮が海外にどれほどの資産を保有しているのかに関するデータはないが、少なくとも中国との中朝貿易の決済をするための資金が中国の銀行に預金されている可能性は高い。やはりこれも、中国がそれらの資金が「核・ミサイル開発計画あるいはその他の禁止された活動に結びついている」と判断するかどうかで、凍結如何が決まることになる。「発覚」が誰によりということが報道では明確ではないが、安保理あるいは国際社会なのか、中国なのかによって状況は変わってくる。

An additional 13 individuals are designated in the resolution as subject to the travel ban and asset freeze, including several representatives of the Korea Mining Development Trading Corporation and the Tanchon Commercial Bank. It designates 12 new entities as subject to the asset freeze, including the Ministry of Atomic Energy and the Reconnaissance Energy Bureau, described as the DPRK's premiere intelligence organization.

また、決議文では、既存の金融制限を強化し、事前に制裁委員会の承認を得ない限り、海外における北朝鮮銀行支店の開店と営業、北朝鮮国内における外国金融機関の事務所の新たな設置を無条件禁止している。
The text also tightens existing financial restrictions by banning the opening and operation of any offices of DPRK banks abroad, as well as the opening of new offices of foreign financial institutions in the DPRK under all circumstances, unless approved by the Sanctions Committee in advance.

２００６年に発効した武器取引禁止措置の幅を広げ、小型兵器、軽量兵器も含めた。改定では、加盟国が北朝鮮軍の発展と能力に資すると判断する食料と医薬品を除く全ての物品の輸送の禁止している。
Turning to the arms embargo, which has been in effect since 2006, the resolution broadens its scope to include small arms and light weapons, which had previously been excluded. It includes a provision that imposes a ban on the transfer of any item, except food and medicine, if a State has reason to believe that it can contribute to the development and capabilities of the DPRK's armed forces.

これも加盟国の判断次第であるが、家庭用扇風機の部品がロケットに使われると判断されれば、扇風機の輸出も禁止されるということであろう。もちろん、その判断基準と実効性が問題となることは間違いない。

北朝鮮は、まだこの決議に対するコメントを出していないが、無視あるいは「自強力」で進む「我々」には効果がないと鼻で笑うか、「宣戦布告に等しい」とするのか、さらにこれを受けて何らかの行動に出るのかは不明である。もちろん、過去記事に書いたように、その裏では六者会談再開への動きがあるので、中国による働きかけに北朝鮮が乗ってくるのかどうかが「今後２ヶ月」間注視しなければならない動きであろう。
また、この決議の発効が即時なのか、ある程度の猶予期間が設定されているのかも上の「今後２ヶ月」と関連し重要なポイントとなるが、この点は上記報道だけでは分からない。

以上、米国務省定例記者会見でも質問が出されていたが、何を基準に定めたのか分からない。「元帥様」の腕時計や執務室の灰皿、「マシンリョンスキー場」のスノーモービル、ロッドマンが「元帥様」と休養地に行った際の映像などを見て、何となく決めたような感がある。
＜追記2＞
「全量検査」については、「自国領を通過」とあるので、陸路も含まれることになる。
「全ての国は、空港、港湾、自由貿易地域を含む自国領を通過する北朝鮮発、北朝鮮向けの貨物を検査する（以下、省略）」
18. Decides that all States shall inspect the cargo within or transiting through their territory, including in their airports, seaports and free trade zones, that has originated in the DPRK, or that is destined for the DPRK, or has been brokered or facilitated by the DPRK or its nationals, or by individuals or entities acting on their behalf or at their direction, or entities owned or controlled by them, or by designated individuals or entities, or that is being transported on DPRK
flagged aircraft or maritime vessels, for the purposes of ensuring that no items are transferred in violation of
resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013) and this resolution, and calls upon States to implement
such inspections in a manner that minimizes the impact on the transfer of cargo that the State determines is for
humanitarian purpose

「石炭・鉄・鉄鋼の取引禁止について」は、留保条項があった。
(a)は、羅先港を経由する外国産の石炭で関係国が委員会に事前通告し、そうした取引が北朝鮮の核・ミサイル開発等の資金として使われないもの。
(b)は、生活目的だけと限定された取引で、核・ミサイル開発等の資金と無関係なもの。
(b)については、その「目的」をどのように限定するのかは、現実的に非常に困難なはずである。実際に北朝鮮が石炭取引により獲得している資金が「人民生活」に使われていることは間違いないが、どこまでを「人民生活」とし、どこまでを「核・ミサイル開発」にするのかという線引き、さらにその資金の流れの追跡など不可能に近い。
29. Decides that the DPRK shall not supply, sell or transfer, directly or indirectly, from its territory or by its nationals or using its flag vessels or aircraft, coal, iron, and iron ore, and that all States shall prohibit the procurement of such
material from the DPRK by their nationals, or using their flag vessels or aircraft, and whether or not originating in the
territory of the DPRK, and decides that this provision shall not apply with respect to:
(a)
Coal that the procuring State confirms on the basis of credible information has originated outside the DPRK and was transported through the DPRK solely for export from the Port of Rajin (Rason), provided that the State
notifies the Committee in advance and such transactions are unrelated to generating revenue for
the DPRK’s nuclear or ballistic missile programs or other activities prohibited by resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013) or this resolution; and,
(b)
Transactions that are determined to be exclusively for livelihood purposes and unrelated to generating revenue for the DPRK’s nuclear or ballistic missile programs or other activities prohibited by resolutions 1718 (2006), 1874
(2009), 2087 (2013), 2094 (2013) or this resolution;
「民間航空機の燃料」についても留保条項があった。まず、「委員会」が、人道的な目的に使われるという理由で事前に許可したもの、燃料の用途をモニターできるような特別な措置が施されたものについては輸出可。これらに「高麗航空機」用が含まれるのかどうかは不明。しかし、海外の空港で北朝鮮航空機が北朝鮮に戻るため、また当該海外空港(return flightをそう解釈したのだが）に戻るための燃料供給は可。そうだとすると、中朝間の「高麗航空機」は、北京、瀋陽等で平壌往復燃料を確保できれば、運航を続けられることになる。
31. Decides that all States shall prevent the sale or supply, by their nationals or from their territories or using their flag vessels or aircraft, of aviation fuel, including aviation gasoline, naptha-type jet fuel, kerosene-type jet fuel, and
kerosene -type rocket fuel, whether or not originating in their territory, to the territory of the DPRK, or unless the Committee has approved in advance on an exceptional case-by-case basis the transfer to the DPRK of such products for verified essential humanitarian needs, subject to specified arrangements for effective monitoring of
delivery and use, and decides also that this provision shall not apply with respect to the sale or supply of aviation fuel to
civilian passenger aircraft outside the DPRK exclusively for consumption during its flight to the DPRK and its return flight
「海外の北朝鮮の銀行等金融機関」については、「新規の開業と営業の禁止」、「委員会の事前承認を受けていない自国領内の北朝鮮銀行との新たな関係構築と既存の関係維持の禁止」、「決議採択から90日以内に自国領内の北朝鮮金融機関を閉鎖する措置を取る」。北朝鮮金融機関との金融取引の禁止だけではなく、支店等の閉鎖まで含まれた厳しい措置。留保条項はあるものの、これは北朝鮮にとっては厳しい制裁となるはずである。支店等の閉鎖措置を取るのに「90日」の猶予期間が設けられていることに留意。
33. Decides that States shall prohibit in their territories the opening and operation of new branches, subsidiaries, and representative offices of DPRK banks, decides further that States shall prohibit financial institutions within their territories
or subject to their jurisdiction from establishing new joint ventures and from taking an ownership interest in or establishing or maintaining correspondent relationships with DPRK banks, unless such transactions have been approved by the
Committee in advance, and decides that States shall take the necessary measures to close such existing branches,
subsidiaries and representative offices, and also to terminate such joint ventures, ownership interests and
correspondent banking relationships with DPRK banks within ninety days from the adoption of this resolution;
「猶予期間」は特に設定されておらず、上記の「90日」を除いては、即発効ということのようだ。しかし、北朝鮮の行動次第では、制裁の猶予や取り消しもあり得るとする一方、さらなる核・ミサイル実験をする場合は、さらに強い措置が取られるとしている。

Transactions that are determined to be exclusively for livelihood purposes and unrelated to generating revenue for the DPRK’s nuclear or ballistic missile programs or other activities prohibited by resolutions 1718 (2006), 1874
(2009), 2087 (2013), 2094 (2013) or this resolution;
「民間航空機の燃料」についても留保条項があった。まず、「委員会」が、人道的な目的に使われるという理由で事前に許可したもの、燃料の用途をモニターできるような特別な措置が施されたものについては輸出可。これらに「高麗航空機」用が含まれるのかどうかは不明。しかし、海外の空港で北朝鮮航空機が北朝鮮に戻るため、また当該海外空港(return flightをそう解釈したのだが）に戻るための燃料供給は可。そうだとすると、中朝間の「高麗航空機」は、北京、瀋陽等で平壌往復燃料を確保できれば、運航を続けられることになる。
31. Decides that all States shall prevent the sale or supply, by their nationals or from their territories or using their flag vessels or aircraft, of aviation fuel, including aviation gasoline, naptha-type jet fuel, kerosene-type jet fuel, and
kerosene -type rocket fuel, whether or not originating in their territory, to the territory of the DPRK, or unless the Committee has approved in advance on an exceptional case-by-case basis the transfer to the DPRK of such products for verified essential humanitarian needs, subject to specified arrangements for effective monitoring of
delivery and use, and decides also that this provision shall not apply with respect to the sale or supply of aviation fuel to
civilian passenger aircraft outside the DPRK exclusively for consumption during its flight to the DPRK and its return flight
「海外の北朝鮮の銀行等金融機関」については、「新規の開業と営業の禁止」、「委員会の事前承認を受けていない自国領内の北朝鮮銀行との新たな関係構築と既存の関係維持の禁止」、「決議採択から90日以内に自国領内の北朝鮮金融機関を閉鎖する措置を取る」。北朝鮮金融機関との金融取引の禁止だけではなく、支店等の閉鎖まで含まれた厳しい措置。留保条項はあるものの、これは北朝鮮にとっては厳しい制裁となるはずである。支店等の閉鎖措置を取るのに「90日」の猶予期間が設けられていることに留意。
33. Decides that States shall prohibit in their territories the opening and operation of new branches, subsidiaries, and representative offices of DPRK banks, decides further that States shall prohibit financial institutions within their territories
or subject to their jurisdiction from establishing new joint ventures and from taking an ownership interest in or establishing or maintaining correspondent relationships with DPRK banks, unless such transactions have been approved by the
Committee in advance, and decides that States shall take the necessary measures to close such existing branches,
subsidiaries and representative offices, and also to terminate such joint ventures, ownership interests and
correspondent banking relationships with DPRK banks within ninety days from the adoption of this resolution;
「猶予期間」は特に設定されておらず、上記の「90日」を除いては、即発効ということのようだ。しかし、北朝鮮の行動次第では、制裁の猶予や取り消しもあり得るとする一方、さらなる核・ミサイル実験をする場合は、さらに強い措置が取られるとしている。
51. Affirms that it shall keep the DPRK’s actions under continuous review and is prepared to strengthen, modify,
suspend or lift the measures as may be needed in light of the DPRK’s compliance, and, in this regard, expresses its determination to take further significant measures in the event of a further DPRK nuclear test or launch
